    For clarity, using our Services or our website constitutes implied consent to the collection, use, and disclosure of your personal information by VoIP.ms in accordance with the terms of this Policy. If you do not agree to VoIP.ms collecting, using, and disclosing your personal information as described in this Policy, your option is not to use our Services.

    Please note that we have no control over the content you, any user of our Services, or any interlocutor interacting with you in the context of your use of the Services may include in a communication made through our Services. Therefore, other types of personal information, including sensitive personal information, may be collected and processed by VoIP.ms because of your use of our Services.

    • Information from Third Parties or Publicly Available Sources: We obtain information about you when you visit other websites that use our cookies. We may also receive information from third parties whom you have authorized to disclose such information, such as advertising networks, analytics providers, pre-employment survey providers, or through publicly accessible data, such as social media (LinkedIn, Facebook, etc.).
    • Indirectly: If you are not a user or customer of VoIP.ms Services but communicate with someone who uses the Services, we may indirectly access your personal information provided to the interlocutor.
    • Government Entities: In very limited cases, we may obtain personal information from government entities, public agencies, or public registers.

    • To ensure the security of stakeholders in our company.

    VoIP.ms may also use your personal information to compile statistics, for example, to identify trends in the use of its Services and improve them. However, these statistics will not identify you and have been anonymized. VoIP.ms retains sole ownership of these anonymized statistics, as well as any other anonymized information collected through its Services.

    VoIP.ms may also create anonymized datasets from personal information, of which it will remain the sole owner. For reference, information is considered anonymized when it is, at all times, reasonably foreseeable under the circumstances that it can no longer, in an irreversible manner, allow for your direct or indirect identification.

    Your personal information will not be used for purposes other than those described above unless we obtain your consent or as required or permitted by law. Without limiting the foregoing, VoIP.ms will never sell or rent your personal information to third parties without your prior explicit consent.

    However, VoIP.ms may use your personal information for other purposes than those described herein, without your consent, in the following cases:

VoIP.ms will never ask you to share sensitive personal information in order to access and use its Services, and we ask that you avoid sharing sensitive personal information with us while using our Services. If you choose to share sensitive personal information with VoIP.ms or in connection with your use of the Services, you acknowledge that such sharing constitutes express consent for VoIP.ms to use and process that sensitive personal information in strict compliance with the terms of this Policy. This may include disclosing that sensitive personal information outside the province or state in which you ordinarily reside, where necessary for VoIP.ms to provide you with its Services.

    For reference, sensitive personal information is information that, due to its nature (such as medical or biometric information, or otherwise intimate details) or the context of its use or disclosure, creates a high level of reasonable expectation of privacy. Examples of sensitive information may include health data, sexual orientation, morphological, behavioural, or biological characteristics, philosophical or religious beliefs, or financial status.

  17. Automated Decision-Making

  18. Your personal information may be used by VoIP.ms to make automated decisions about services that may be of interest to you or relevant to you, as well as to detect and prevent fraud. Such automated decision-making will not have any legal or binding effect on you. Upon request, VoIP.ms will provide you with information regarding the functioning of any such automated system.

  19. Disclosure of Your Personal Information to Third Parties

  20. VoIP.ms acknowledges that, except in the cases and under the conditions described below or when authorized by law, the disclosure of your personal information to third parties requires your consent.

    Access to your personal information within our company does not require your consent but is strictly limited to individuals for whom such information is necessary to perform their duties and responsibilities.

    VoIP.ms may share your personal information, without your consent, with its agents, service providers, suppliers, consultants, or other partners who need this information as part of VoIP.ms' operations or to assist VoIP.ms in administering its Services and business. VoIP.ms also shares your personal information with other telecommunications service providers to offer you efficient Services. For example, when you make local or international calls or send messages, VoIP.ms relies on third-party providers to efficiently route your calls and messages over the global telecommunications network. These agents, service providers, suppliers, consultants, and other partners will contractually guarantee that they will use the personal information disclosed to them solely to provide specific services and will respect its confidentiality in accordance with this Policy.

    VoIP.ms may also, without your consent, disclose your personal information when authorized or required by law, such as (i) to a person to whom the information must be communicated under applicable law, (ii) to prevent fraud or a serious risk of physical harm to any person, (iii) in the context of debt collection, (iv) in the context of exercising its legal rights and legal proceedings, or (v) to a public or governmental agency. Whenever VoIP.ms needs to disclose personal information about you, it will strive to disclose only the minimum amount of information necessary under the circumstances.

    VoIP.ms may also share your personal information when involved in a business transaction involving the sale or transfer of all or part of its business or assets. This may include a merger, financing, acquisition, transaction, or bankruptcy proceeding.

    • Administrative or organizational measures (for example, restricting access to only what is strictly necessary, limiting changes according to the principle of least privilege); and
    • Technological measures (such as the use of passwords and multi-factor authenticators, the use of a firewall, data encryption, use of SSL protocol, and using technology providers who adhere to industry best standards) that are reasonable considering the sensitivity of the information, its usage, its volume, distribution, and medium.

    VoIP.ms also takes the necessary steps to ensure that all its employees are informed about the content of this Policy and trained in personal information protection practices.

    However, since no security mechanism is infallible, there is always some degree of risk.

    If a privacy breach involving personal information occurs, VoIP.ms will disclose the incident, when required by law, to the applicable governmental authority (such as Quebec's Commission d'accès à l'information, the Office of the Privacy Commissioner of Canada, or the competent regulatory authority within the European Union) and to the individuals concerned and will adopt measures to mitigate the impact of the security incident on the individuals affected.

  27. Accuracy

VoIP.ms acknowledges the importance of ensuring that personal information is accurate, complete, and up to date, and it takes reasonable steps to verify the accuracy and completeness of the information it uses or discloses. However, it is your responsibility to inform VoIP.ms of any significant changes to your personal information and to ensure that all personal information in your account is accurate.

    VoIP.ms retains your personal information only for the duration necessary to fulfill the purpose for which it was collected, to meet legal retention requirements, and for the time necessary to protect its legitimate business interests.

    Once the purposes for which your personal information was collected or used have been achieved, we will either destroy your personal information or anonymize it for use for legitimate and lawful purposes, except where the law requires us to retain certain information or where we need to retain specific information to exercise our rights or defend ourselves in legal proceedings. Information is considered anonymized when it is, at all times, reasonably foreseeable under the circumstances that it no longer allows for your direct or indirect identification in an irreversible manner.

  29. Processing of Personal Information of Individuals Located in the European Economic Area (EEA) and/or in the EU

  30. VoIP.ms complies with the provisions of the GDPR where applicable. Section 15 of this Policy applies exclusively to the processing of personal information related to the EEA and the EU, insofar as this processing occurs while the individuals concerned are located in the EU or EEA, and when the processing activities are related to the offering of goods or services or the monitoring of the behaviour of these individuals, to the extent that such behaviour takes place within the EEA or the EU. In the event of a conflict between this Section 15 and the rest of the Policy, the provisions of this Section will take precedence, but only when the processing occurs while the individuals concerned are located in the EU or EEA, and when the processing activities are related to the offering of goods or services or the monitoring of the behaviour of these individuals, to the extent that such behaviour takes place within the EEA or the EU.

    1. Consent – If your consent is provided in a written statement that addresses other subjects, VoIP.ms will ensure that the request for consent to process your personal information is clearly distinct from the other subjects.
    2. Collection, Retention, and Use of Personal Information – VoIP.ms will not retain personal information longer than necessary to fulfil the purposes for which it was collected. VoIP.ms will take reasonable steps to make known, in advance, the period during which personal information may be retained or the criteria used to determine this period.
    3. Automated Individual Decision-Making – VoIP.ms acknowledges that you have the right to know if your personal information is being processed by an automated decision-making system. Upon request, VoIP.ms will provide you with information about the functioning of this automated system. Unless required or authorized by law, you have the right to refuse that a decision based solely on an automated system be made about you, where such a decision has legal consequences for you.
    4. Privacy Impact Assessment – VoIP.ms will conduct a privacy impact assessment before implementing new technologies that are highly likely to affect your rights and freedoms, including your right to privacy.
    5. Right to Erasure – Where provided by law, you have the right to request that VoIP.ms remove and erase personal information without unreasonable delay.
    6. Accuracy and Protection – VoIP.ms will implement appropriate technical and organizational measures to ensure the protection of personal information before collecting it.
    7. VoIP.ms will only share personal information with agents, representatives, consultants, data processing companies, or external service providers when they ensure that appropriate measures are in place to protect personal information.

    8. Accountability – VoIP.ms acknowledges that it is responsible for the protection of personal information and that it is able to demonstrate its compliance with the GDPR when processing personal information.
    9. Complaint Procedure, Right of Access, or Rectification – VoIP.ms takes all necessary measures to facilitate your right of access, rectification, or retrieval of your personal information. You can always obtain confirmation from us as to whether personal information is being processed.     You have the right to request access to and view the personal information held about you by VoIP.ms. You also have the right to obtain confirmation that we hold personal information about you. We will provide your personal information, when collected electronically, in a structured and commonly used technological format. You may also request that your personal information be rectified if it is inaccurate, incomplete, or unclear, or if its collection, disclosure, or retention is not authorized by law, by making a request to the Privacy Officer.

    VoIP.ms will respond to any request for access or rectification within 30 days from the date of receipt of the written request. In the event of a refusal to provide or correct the information, VoIP.ms will provide you with the reasons for the refusal and the applicable legal provisions that support the refusal, subject to the restrictions provided by law, and will inform you of your recourse options.

    If VoIP.ms refuses to rectify your personal information, we will allow you to add written comments to your file regarding the personal information for which rectification was refused. VoIP.ms will also retain personal information subject to an access request for as long as necessary to allow you to exhaust any legal recourse.
